Fraud, primarily identify theft, is a common occurrence in today's world. Although lenders / credit grantors take great steps in attempting to identify fraud unfortunately criminal elements are always one step ahead.
Even the most experienced and vigilant consumers have been victims of fraud.
As a means of control often the trafficker holds the survivor's identity. Even if they do not they know key information (example date of birth). With this information a trafficker can easily apply for a credit card (s) on line without the survivor's knowledge.
Traffickers also use accomplices, posing as the survivor, to apply for credit in person.
All of this is activity is fraud and the survivor is not responsible for repayment of the debt.
Coercion is at the core of a trafficker's control over their victim.
The coercion is also the basis for a significant part of the debt issues a survivors face after their exploitation.
Survivors are forced to obtain cell phone(s) in their name for the sole benefit of the trafficker.
The concept of coercion is extended to lease agreements, utility accounts, loans, etc.
Coercion is not limited to credit instruments obtained after trafficking. If survivor's had pre-existing credit cards or bank accounts traffickers will exploit those.
Survivors are not responsible for debt that is a result of coercion.
The types of credit fraud and coercion that are most common are credit cards, cell phones, car rental and student loans.
Survivors have proven that fraud and coercion are closely tied together at times.
Traffickers generally take great effort to keep their name out of all aspects of trafficking. They know that this makes it difficult for law enforcement to prove elements of trafficking
If they are renting a car they may use a fraudulent credit card they obtain in the survivor's name and force the survivor to sign the car rental agreement. The survivor's knowledge of the existence of the credit card is not proof that they are liable for any debt arising from the car.
If the trafficker causes damages to the car or don't pay parking tickets (which they don't care about) the car rental agency will pursue the survivor.
Even in these cases the survivor is not responsible for repayment.
Protecting your credit history and ensuring its accuracy is an important part of post trafficking experience.
If something is inaccurate it needs to be corrected. Reputable lenders would never want a consumer to have to pay a fee to fix something that is simply wrong.
Fraud and Coercion is wrong.
Fixing multiple issues on a credit file is a daunting task. This task is further complicated by the different details a creditors may ask for.
We know this process unfairly re-victimizes survivors. And most creditors are understanding and take great lengths to work and protect survivors.
